Terms of service

§1 General Provisions

1. The online store operating at ddugx4-ag.myshopify.com is run by Przedsiebiorstwo Handlowo-Uslugowe POSITIVE Arkadiusz Szczyrbowski, Brzeziny 5, 43-502 Czechowice-Dziedzice, Poland, VAT number: PL6520009915, e-mail: positive@onet.eu, phone: +48 600 805 152 ("Seller").
2. These Terms of Service set out the rules for using the Store, placing orders, concluding and performing sales contracts, and the complaints procedure.

§2 Definitions

Customer – a natural person, legal person, or organizational unit making purchases in the Store.
Consumer – a Customer who is a natural person making a purchase not directly related to their business or professional activity.
Goods – a product offered for sale in the Store.
Sales Contract – a distance contract concluded between the Seller and the Customer.

§3 Technical Requirements

Using the Store requires a device with internet access, a web browser, and an active e-mail account.

§4 Placing Orders

1. Orders can be placed 24 hours a day through the Store.
2. Placing an order constitutes an offer to conclude a sales contract within the meaning of the Polish Civil Code.
3. The contract is considered concluded upon the Seller's confirmation of order acceptance, sent to the Customer's e-mail address.

§5 Prices and Payment

1. All prices shown in the Store are gross prices (including VAT) and are expressed in the currency applicable to the relevant market (PLN for Poland, EUR for other EU countries served).
2. Available payment methods are indicated during the order process.
3. Delivery costs are shown separately and added to the price of the Goods in accordance with the Shipping Policy.

§6 Order Fulfilment and Delivery

Order fulfilment and delivery times are set out in the Shipping Policy available in the Store.

§7 Right of Withdrawal

1. The Consumer has the right to withdraw from a distance contract within 14 days without giving any reason.
2. The withdrawal period expires 14 days after the day on which the Consumer took possession of the Goods.
3. To exercise the right of withdrawal, the Consumer must inform the Seller of their decision by an unambiguous statement (e.g. a letter sent by post or e-mail to positive@onet.eu). The Consumer may use the withdrawal form template attached at the end of these Terms, although this is not mandatory.
4. The Consumer bears the direct cost of returning the Goods.
5. The Seller will reimburse all payments received, including delivery costs (except for additional costs resulting from a delivery method chosen by the Consumer other than the cheapest standard delivery offered by the Seller), without undue delay and no later than 14 days from the day the Seller receives the Consumer's statement of withdrawal.
6. The Seller may withhold reimbursement until the Goods have been received back.
7. The Consumer is liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Goods.

§8 Complaints (Statutory Warranty)

1. The Seller is liable to the Consumer for the conformity of the Goods with the contract on the terms set out in the Polish Consumer Rights Act of 30 May 2014. This liability lasts for 2 years from the date the Goods are delivered to the Consumer.
2. Complaints may be submitted electronically to positive@onet.eu or in writing to the Seller's address.
3. The Seller will respond to a complaint within 14 days of receiving it.

§9 Out-of-Court Dispute Resolution

The Consumer may use out-of-court methods of handling complaints, including the EU Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr

§10 Personal Data

The rules for processing Customers' personal data are set out in the Privacy Policy available in the Store.

§11 Final Provisions

1. Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
2. The Seller reserves the right to amend these Terms for valid reasons. Orders placed before any amendment takes effect will be fulfilled under the previous terms.
3. These Terms take effect on the date of publication.
